The housing market is on fire but, making that deal of a lifetime may not be all it’s cracked up to be. Inspections are increasingly being waived by those eager to get their dream home or sell while the market is hot. Without them, however, it is not always 100% clear exactly what is being bought and sold. As a result, real estate misrepresentation cases are at an all-time high.
When buyers buy a home that does not meet their expectations, tensions run high, and lawsuits are filed based on misrepresentation. When sellers are sued for misrepresentation, it can be a fee-shifting claim that entitles the buyers to an award of actual attorney’s fees. Having an experienced attorney who understands the rights and responsibilities of buyers and sellers is important in misrepresentation cases.
