Appeals 101: What Clients Should Know Before Challenging a Court Decision

by | Sep 4, 2026

Think an appeal is simply asking for a new trial? Not quite.

Here are a few things many people don’t realize about appeals:

  • An appeal is not a new trial. A higher court reviews the trial court’s decision for legal errors using the existing record.
  • Not every unfavorable outcome can be appealed. There generally must be a legal error or an important question of law.
  • Appeals can arise from many types of cases, including family law, contract disputes, insurance matters, personal injury, legal malpractice, and product liability.
  • The timeframe to file an appeal is often short. Seek legal guidance promptly.
